Filing Damage Claims
Section 10.09, of the City Charter sets out procedures regarding the filing of damage claims as follows:

“Section 10.09 - “Special Provision Covering Damage Suits.”

(a) The city shall not be liable for damages, injury or death unless written notice is received by the city secretary in compliance with the Texas Tort Claim Act.
(b) Reserved.
(c) Written notice as required by (a) hereof shall not be required if good cause sufficient to satisfy legal requirements for the validity of (a) hereof exists.”

Procedures for Filing Claim

  • Your claim must be filed within (6) months after the incident (Pursuant to Texas Tort Claim Act).
  • The claim form must be signed before a Notary Public, but if you do not have a notary public available to you, the City Secretary’s office will be happy to notarize at no charge.
  • The claim form may be mailed or delivered in person to the City Secretary for processing, 1505 Precinct Line Road, Hurst, Texas 76054.
  • Upon receipt, your claim will be forwarded to the Risk Manager for review and recommendation as the City’s liability regarding the claim. You will be contacted regarding the City’s decision.
